DOT’s Notice on Testing for Marijuana
On December 18, 2025, a significant shift occurred in the landscape of marijuana regulation when the President of the United States issued an Executive Order directing the Department of Justice to reschedule marijuana from a Schedule I to a Schedule III drug under the Controlled Substances Act (CSA). This decision has prompted numerous inquiries about its implications for safety-sensitive transportation employees, which include pilots, truck drivers, school bus drivers, train engineers, and other critical personnel responsible for the safety and efficiency of our transportation systems.
What Does This Mean for Transportation Employees?
Firstly, it’s important to clarify that marijuana remains classified as a Schedule I drug under the CSA until the rescheduling process is finalized. As such, the Department of Transportation (DOT) maintains its strict regulations regarding the use of marijuana by safety-sensitive employees. This means that for the time being, these employees are prohibited from using marijuana, regardless of any changes that may come in the future.
Consistency in Drug Testing Regulations
The DOT's drug testing protocols will not change during the rescheduling process. All employees in safety-sensitive positions will still be subject to rigorous testing for marijuana use. Furthermore, existing guidelines regarding both medical and recreational marijuana, as well as CBD products, remain in effect. This consistency ensures that employees and employers can rely on established procedures as they navigate these evolving regulations.
Roles and Responsibilities
Laboratories, Medical Review Officers, and Substance Abuse Professionals are reminded to adhere to 49 CFR Part 40. There is no alteration to their roles and responsibilities concerning marijuana testing during this time. The commitment to a safe transportation system remains paramount, and all parties involved are expected to continue upholding the highest safety and compliance standards.
